Resolution Declaring Dangerous and Unfit Structures
Whereas on the 6th day of October, 2009 a resolution was passed which declared the following describe property to be declared a Dangerous and Unfit Structure pursuant to Code Section 4-504.
South half of Lots 7, 8 and 9, Block 11, Addition 1 of the City of St. John,
Stafford County, Kansas;
Whereas a public notice was published on August 12th, 2009 and August 19th, 2009, two consecutive weeks in the St John News notifying the owners and anyone else who had an interest in said properties that a hearing was to be held on September 22nd, 2009 pursuant to Code Section 4-505 granting the owners or anyone else who might have an interest in the property to appear at said hearing and present any evidence they might deem appropriate.
Whereas on September 22nd, 2009 the hearing was held. There were no persons in attendance to contest the resolution proposed by the City Council declaring said properties to be declared dangerous and unfit structures.
Now therefore the City Council finds that the above described property is a dangerous and unfit structure for the following reasons.
1. The structure in unfit for human habitation.
2. The structure is unsafe because it is a fire hazard.
3. The structure is structurally defective and unsanitary.
4. The structure causes blight on the surrounding neighborhood.
5. The City Council finds that the property either needs to be repaired or closed and demolished with the structure being removed from the property.
6. The City Council finds that the property shall be cleaned up within 60 days from the date of this resolution. If the owner or other person having an interest in said property fails to repair said structure to a condition fit for human habitation, then said property shall be razed and removed and the cost of said action shall be assessed as provided in City Code Section 4-511.
This resolution shall be published in the St John News on the October 14th, 2009 and a copy of the resolution shall be served on the owners or other persons claiming an interest in this tract as provided in Code Section 4-507.
The council hereby approves the findings of fact in this resolution and adopts the same this October 6th, 2009.
