              CHAPTER XII.  PUBLIC PROPERTY

              ARTICLE 1.  CITY PARKS

 

12-101.                            CITY LAWS EXTENDED TO PARK.  The laws of the city shall extend to and cover all city parks.  (Code 1991)

 

12-102.                            POLICE JURISDICTION OVER PARKS.  The city shall have police regulations governing any public parks belonging to the city and the chief of police and law enforcement officers of the city shall have full power to enforce city laws governing city parks and shall maintain order therein. (Code 1991)

 

12-103.                            DAMAGING PARK PROPERTY.  It shall be unlawful for any person, except duly authorized city employees,  to willfully or wantonly remove, injure, tarnish, deface or destroy any building, walk, bench, tree or improvement or property of any kind belonging to any park owned by the city. (Code 1991)

 

12-104.                            DANGEROUS WEAPONS NOT ALLOWED.  (a)  Except as provided in subsection (b), it shall be unlawful for any person to carry or have in his or her possession any firearm or dangerous weapon  or to shoot or discharge the same within the limits of any city parks.

              (b)              The provisions of subsection (a) above shall not apply to duly authorized law enforcement officers in the performance of official duty.

12-105.                            VEHICLE REGULATIONS.  (a)  Motor vehicles, including any vehicle licensed to operate on public streets, roads and highways and motorbikes, go- carts, snowmobiles and other motorized off-the-road vehicles shall be operated in a safe and prudent manner at all times in park areas.

              (b)              Except as provided in subsection (d), it shall be unlawful for any person to park any motor vehicle in any area not designated for such purpose.

              (c)              Except as provided in subsection (d), it shall be unlawful for any person to operate any motor vehicle within any city park except upon roads, drives and parking areas established by the city.

              (d)              Subsections (b) and (c) above shall not apply to authorized city employees while engaged in the maintenance and care of the park.

              (e)              It shall be unlawful to operate any such vehicle in any park area at a speed in excess of 20 m.p.h.

12-106.                            HUNTING.  It shall be unlawful for any person to pursue, catch, trap, maim, kill, shoot or take any wildlife, either bird or animal, in any manner at any time while in any city park.  (Code 1991)

 

12-107.                            FIRES.  It shall be unlawful for any person to build or kindle any fire in any city park except in the ovens, stoves, or grills provided for that purpose by the city, and such fire must be extinguished by the person, persons or parties starting such fire, immediately after use thereof.  (Code 1991)

 

12-108.                            CAMPING PROHIBITED.  Overnight camping is hereby prohibited in city parks except where posted.  (Code 1991)

 

12-109.                            SANITATION.  All waste material, paper, trash, rubbish, tin cans, bottles, containers, garbage and refuse of any kind whatsoever shall be deposited in disposal containers provided for such purposes.  No such waste or contaminating material shall be discarded otherwise.  No sticks, stones, trash or other objects shall be thrown or discarded in or on any park lands, fountains, pools, drinking fountains, sanitary facilities, or other improvements.  (Code 1991)

 

12-110.                            PROHIBITION AGAINST ALCOHOLIC BEVERAGES AND CEREAL MALT BEVERAGES.  It shall be unlawful for any person or persons to use, consume or have on the premises of any park or other city property within the city any alcoholic liquor or cereal malt beverage.  (Code 1991)

 

12-111.                            PRESERVATION OF NATURAL STATE.  It shall be unlawful for any person, except duly authorized city employees, to take, injure, or disturb any live or dead tree, plant, shrub, or flower, or otherwise interfere with the natural state of city parks.  (Code 1991)

 

12-112.                            GENERAL REGULATIONS.  The city may post such rules and regulations, as are approved by the governing body, pertaining to the use of the city parks in a conspicuous place in each city park.  Violations of these posted rules shall constitute a violation of this code.  (Code 1991)

 

 

              ARTICLE 2.  PUBLIC DUMP

 

12-201.                            REGULATION.  The following described area is hereby declared the official dump of the city.  A tract of land in the southwest Quarter (SW/4) of Section 34, Township 23 South, Range 13 West of the 6th P.M., in Stafford County, Kansas, more particularly bounded and described as follows:

              Commencing at a point on the south line of the quarter section 1,727 feet east of the southwest corner thereof; running thence north 1,092 feet; thence east to a point 209 feet west and 1,092 feet north of the southeast corner of the quarter section; thence south parallel to the east line of the quarter section to a point 209 feet west of the southeast corner of the quarter section; thence west along the south line of the quarter section to the point of beginning, containing 17.30 acres, more or less.  (Code 1984, 11-101)

 

12-202.                            DEFINITIONS.  For the purpose of this article the following words shall have the following meaning:

              Combustible:  Brush, trees, shrubs, grass clippings and clean waste wood, free of excess dirt or other extraneous matter that will inhibit combustion.

              NonCombustible:  Any item not specifically described as a combustible shall be a non-combustible.

12-203.                            NO OPEN BURNING.  No material of any type, combustible or noncombustible, may be burned at the city dump except by authorized city personnel.  (Code 1984, 11-103)

12-204.                            UNLAWFUL BURNING AND DUMPING.  It shall be unlawful for any person to dump any noncombustible at the city dump.  (Code 1984, 11-104)

 

12-205.                            HOURS OF OPERATION.  (a)  Public Access.  The dump shall be open to the public for dumping on the days and for the hours as may from time  to time be prescribed by the governing body by public notice thereof published in the official city newspaper and posted at the dump site.

              (b)              Fees.  The governing body may from time to time prescribe fees to be charged the public for the use of the dump site by resolution.  Public notice of such fees shall be given by publication in the official city newspaper and by posting the same at the dump site.

              (c)              Time of Burning.  Open burning shall not be initiated by authorized personnel until at least one hour after sunrise.  No material shall be added to any fire two hours before sunset.

              (d)              Meteorological Conditions.  Burning shall not be carried out during inclement or foggy conditions or on very cloudy days.  Cloudy days will be defined as overcast days (more than 0.7 cloud cover) with a ceiling of less than 2,000 feet.  In addition, burning shall be restricted to periods when surface wind speed is more than five mph and less than 15 mph, and from a direction which will not carry the smoke over any occupied dwellings or public roadways or any airports within two miles of the burning site.

              (e)              Road Hazards.  Conditions of burning within 1,000 feet of a roadway which provide potential traffic safety hazards or any other safety hazards shall be avoided by appropriate notifications of the Highway Patrol, sheriff's office or other appropriate authorities.

              (f)              Safety.  Burning shall be supervised until the fire is extinguished.

12-206.                            BURNING SUPERVISOR.  During such hours as a burning supervisor is not on duty at the dump, the chief of police or such patrolman as he or she may direct shall supervise all burning at the dump.  (Code 1984, 11-106)

 

12-207.                            SECTION 12-208 LIMITED IN APPLICATION.  Section 12-208, relating to the use of the dump site, shall not apply to the provisions set out above notwithstanding any similarity in section titles and numbers.  (Code 1984, 11-107)

 

12-208.                            PUBLIC DUMP CLOSED.  That tract of ground described in 12-201 above and known as the public dump of the city is hereby closed to the public and it shall be unlawful for any person to dispose of solid waste is defined in 12-202 upon the above described premiss unless such disposal is authorized by a written lease agreement or contract made and entered into by the governing body of the city.  (Code 1984, 11-112)

 

12-209.                            LEASE AUTHORIZED.  The governing body is hereby authorized to enter into a lease, agreement, or contract with any public or private firm, person or corporation for the use of the real estate described in 12-201 above under such terms and conditions as the governing body may deem fit and proper.  The mayor of the city is hereby authorized to execute such lease after the same has been approved by the governing body of the city.  (Code 1984, 11-113)

 

 

              ARTICLE 3.  TOMORROW COMMITTEE

 

12-301.                            TOMORROW COMMITTEE; ESTABLISHED.  The St. John Centennial Committee shall be known as the St. John Tomorrow Committee.  (Ord. 825, Sec. 1)

 

12-302.                            MEMBERSHIP.  The St. John Tomorrow Committee shall consist of not less than five nor more than seven members to be appointed by the mayor with the approval of the council.  Terms of membership for the initial appointees shall be for September 1, 1987 through June 30, 1988.  Terms of members appointed thereafter shall be for a one year period from July 1st to June 30th.  (Ord. 825, Sec. 2)

 

12-303.                            DUTIES.  The St. John Tomorrow Committee shall cooperate with the city governing body and civic groups in  the city and the surrounding community for the purpose of establishing short-range and long-range plans for making the city more beautiful. The St. John Tomorrow Committee shall be responsible for financing such activities, providing programs and entertainment for such activities, and planning beautification projects for the city.  (Ord. 825, Sec. 3)

 

12-304.                            AUTHORITY.  The St. John Tomorrow Committee shall have the authority to establish committees and name the members thereof for the purpose of carrying out its duties named herein.  The St. John Tomorrow Committee shall have the authority to solicit and accept donations for the purpose of financing the aforementioned activities.  Such donations shall be made to the city.  (Ord. 825, Sec. 4)

 

12-305.                            FUND.  The fund which has been established and is now known as the St. John Centennial Commission Fund shall be known as the St. John Tomorrow Committee Fund.  All moneys received by the St. John Tomorrow Committee shall be deposited in the fund and all moneys expended by the St. John Tomorrow Committee shall be expended from the fund. Vouchers submitted by the committee shall be subject to and shall follow the standards procedure for the submission and approval of vouchers.  (Ord. 825, Sec. 5)
